A friend forwarded this article to me regarding a lawsuit filed by the National Wildlife Federation and a subsequent National Marine Fisheries Service call for a moratorium of new development in floodplains in the Northwest.  I am unsure if the article reflects the situation accurately, but if you know please let the AWRA blog readers in on your information!   Low Impact Development (LID) was mentioned as a mitigation measure for new development in the floodplain.  If you have a moment and you care to, let us know what you think would be suitable mitigation measures for floodplain development, including LID strategies?  Finally, since this possible court decision connects landuse and water through the Endangered Species Act, what kind of policy implications do you see in the future?

Millions of people would be left in harms way and the economic losses would be really high if no flood insurance was available to them. The bill for recovery would be passed down to tax payers.
Let’s not forget that the local communities decide how to manage the NFIP as far as building permits. The NFIP is even optional.
